Privacy Policy

Welcome to deboladesigns.com (“the Site”), a website operated by DEBOLA DESIGNS. The use of “we”, “us”, or “our” throughout this document applies exclusively to Debola Designs, LLC.   

Debola Designs understands the importance of protecting your personal information and we take great care to protect your information. We take your privacy seriously, and we want you to know how we collect, use, share, and protect your information. This Privacy Policy describes the ways in which we gather and protect information, and how you can control your personal information.

To be clear about the terminology we are using, when we use the phrase “Personal Information” in this Privacy Policy, we mean contact information (e.g., name, address, email address, or telephone number) and any other non-public information that is used or intended to be used to personally identify an individual. When we use the phrase “Anonymous Information” in this Privacy Policy, we mean information that is neither used nor intended to be used to personally identify an individual.

Children

The Site is not directed or solicited to children and children are not eligible to use our Site.  Protecting the privacy of children is very important to us. We do not collect or maintain Personal Information from people we know are under 13 years of age, and no part of our Site is designed to attract people under 13 years of age. When the Site does collect age information, and users identify themselves as under 13, we will take steps to remove that user’s Personal Information from our databases and to prevent the user from utilizing the Site. Additionally, by using this Site, you are acknowledging that you are at least 18 years old.

How We Collect Information

Personal Information

In general, the Personal Information we gather enables us to process your orders, and to provide Products to you.  We collect Personal Information that you submit to us voluntarily when you register an account with us or order Products. To create an “Account” with a username, we require that you provide certain Personal Information, including your name and email address.

You are not required to have an Account to place an order. To place an order on the Site, we will require additional information from you, including your mailing address and phone number. ALL PAYMENTS ON THE SITE ARE PROCESSED BY OUR SERVICE PROVIDERS (Paypal, Stripe) who collect your credit card information directly, and we will not have access to use or see your credit card information as part of such transaction.  We also collect other types of personal information that you provide to us voluntarily as you use the Site or if you contact us via email regarding the Site or Products.

If you participate in a sweepstakes, contest, or giveaway on our Site or social media pages, we may ask you for your email address and/or phone number (to notify the winner).  In such cases, we may also ask you to verify your first and last name, email address, and/or current physical address. In some situations we may need additional information as a part of the entry process, such as a prize selection choice.  These sweepstakes and contests are voluntary. We recommend that you read the rules for each sweepstakes and contest that you enter.

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Anonymous Information

  • Information Collected by Our Servers.  To make our Site more useful to you, our servers (which may be hosted by a third party service provider) collect information from you, including your browser type, operating system, Internet Protocol (“IP”) address (a number that is automatically assigned to your computer when you use the Internet, which may vary from session to session), domain name, and/or a date/time stamp for your visit.
  • Log Files.  As is true of most websites, we gather certain information automatically and store it in log files.  This information includes IP addresses, browser type, Internet service provider (“ISP”), referring/exit pages, operating system, date/time stamp, and clickstream data.  We use this information to analyze trends, administer the Site, track users’ movements around the Site, gather demographic information about our user base as a whole, and better tailor our Site to our users’ needs.  For example, some of the information may be collected so that when you visit the Site again, it will recognize you and the information could then be used to serve advertisements and other information appropriate to your interests. Except as noted in this Privacy Policy, we do not link this automatically-collected data to Personal Information.
  • Cookies.  Like many online services, we use cookies to collect information.  “Cookies” are small pieces of information that a website sends to your computer’s hard drive while you are viewing the website.  We may use both session Cookies and persistent Cookies to provide you with a more personal and interactive experience on our Site. Session cookies will expire once you close your website, while persistent cookies stay on your computer until you delete them. This type of information is collected to make the Site more useful to you and to tailor the experience with us to meet your special interests and needs. Cookies are used to analyze trends, administer the website, track users’ movements around the website, and to gather demographic information about our user base as a whole. Customers can control the use of cookies at the individual browser level. If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year. If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser. When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select “Remember Me”, your login will persist for two weeks. If you log out of your account, the login cookies will be removed.
  • Embedded Content. This site may include embedded content (e.g. videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website. These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracking your interaction with the embedded content if you have an account and are logged in to that website.
  • Third Party Analytics.  We may use a third party tracking service such as Google Analytics to track and analyze Anonymous Information from users of our Site. Such third parties may use Cookies to help track user behavior. The use of these Cookies by third parties is not covered by our Privacy Policy. We do not have access or control over these Cookies. For example, Google Analytics collects only the IP address assigned to you on the date you visit the Site, rather than your name or other personally identifying information.  We do not combine the information generated through the use of Google Analytics with your personal information. Although Google Analytics plants a persistent Cookie on your web browser to identify you as a unique user the next time you visit the Site, the Cookie cannot be used by anyone but Google.  Google’s ability to use and share information collected by Google Analytics about your visits to the Site is restricted by the Google Analytics Terms of Use and the Google Privacy Policy. Please refer to Google’s privacy policy if you need more information about how they use and collect your data.

How We Use Information

Personal Information

We will use your Personal Information to:

  • Administer your account
  • Process your payments and fulfill your orders 
  • Provide you with the Site and customer support
  • Identify you on the Site in order to tailor the features, performance, and support of the Site to you
  • Market our products and services to you that we believe may be of interest to you
  • Respond to your requests, resolve disputes and/or troubleshoot problems
  • Improve the quality of the Site and the Products
  • Communicate with you about the Site and the Products.
  • Processing refunds, returns, and exchanges
  • Tracking and confirming online orders
  • Conducting research and analysis

We may also use your Personal Information to create Anonymous Information records by excluding information that makes the information personally identifiable to you.

We will communicate with you primarily in the form of email. You can opt out of receiving certain communications from the Site such as our newsletter by clicking the “Unsubscribe” link at the bottom of each email or emailing us at support@deboladesigns.com. Please note that even if you unsubscribe or opt-out of our newsletter, we may still send you order information, as well as Site and Product related communications (e.g., emails related to your orders or comments/questions). 

How We Disclose Information

Personal Information

Debola Designs does not sell, rent, or trade your personal information to third parties. We share your information only in the ways we describe below

We may disclose certain Personal Information:

  • To third party vendors who help us provide the Site or sell Products to you, including vendors that process purchases for us
  • To third parties to whom you ask us to send Personal Information
  • To a parent company, any subsidiaries, joint ventures, or other companies under a common control (collectively, “Affiliates”). In the event we have such Affiliates in the future, we will require our Affiliates to honor this Privacy Policy
  • If we believe in good faith that such disclosure is necessary to (i) resolve disputes, investigate problems, or enforce our Terms of Use; (ii) comply with relevant laws or to respond to requests from law enforcement or other government officials relating to investigations or alleged illegal activity, in which case we can (and you authorize us to) disclose Personal Information without subpoenas or warrants served on us; or (iii) protect and defend our rights and property or the rights and property of you or third parties.

Some aspects of our Site may enable you to post content to social media services such as Facebook, Instagram, or Twitter.  If you choose to do this, we will provide information to such services in accordance with your elections. You acknowledge and agree that you are solely responsible for your use of those websites/services and that it is your responsibility to review the terms of use and privacy policy of the third party provider of such social media service.  We will not be responsible or liable for: (i) the availability or accuracy of such social media service; (ii) the content, products, or services displayed on the social media service; or (iii) your use of any such social media service.

Social media features can be hosted by a third party or hosted directly on our website. Your interactions with these features are governed by the privacy policy of the social media company providing the feature. 

Anonymous Information

We reserve the right to use Anonymous Information for any purpose and disclose Anonymous Information to third parties at our sole discretion.

We reserve the right to disclose Anonymous Information publicly without restriction, including to third party vendors who may help us enhance or provide the Site or to third parties.

Information Disclosed to Third Parties

This Privacy Policy addresses our use and disclosure of information we collect from and/or about you on the Site.  If you disclose information to others, including payment processors, different rules may apply to their use or disclosure of the information you disclose to them.  The use and disclosure restrictions contained in this Privacy Policy will not apply to any third party.  We do not control the privacy policies of third parties, and you are subject to the privacy policies of those third parties where applicable.

The Site may contain links to other websites that are not owned or controlled by us, including our partner sites. We have no control over, do not review, and are not responsible for the privacy policies or content displayed on such other websites. When you click on such a link, you will leave our Site and go to another site.  During this process, another entity may collect Personal Information or Anonymous Information from you. The Site may also contain links to other websites controlled by us but which operates under different privacy policies. Please review the privacy policy of any new website you visit.

Updating and Controlling Your Information.

If you have an Account with us, you may update your Personal Information on our Site. You may also email us at support@deboladesigns.com. You may request deletion of your Personal Information by us, but please note that we may be required (by law or otherwise) to keep this information and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements). When we delete Personal Information, it will be deleted from the active database, but may remain in our archives and we may also retain Anonymous Information about your use of our Site and purchase of Products.  Once we disclose some of your Personal Information to third parties, we cannot access that Personal Information any longer and cannot force the deletion or modification of any such information by the parties to whom we have made those disclosures.

How long we retain your data

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue. For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

How we protect your information.    

We use a variety of information-security measures to protect your online transactions with us.

  • We use reasonable security measures to protect the confidentiality of personal information under our control and appropriately limit access to it.
  • We use encryption technology to protect your personal information (SSL encryption).

We are committed to protecting your information, but you can do your part. You should create a strong password and protect against unauthorized access to your password and your computer. Be sure to sign off when finished using a shared computer and do not share your password with anyone. We cannot guarantee the security of any information you transmit to us, and by using our digital properties you acknowledge that you do so at your own risk.

What rights you have over your data

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

Changes to this Privacy Policy.

This Privacy Policy is subject to revision from time to time.  We will post any revised version of the Privacy Policy on this page.  A notice of any major changes made to this Privacy Policy may be sent to the last email address you have provided to us.  Continued use of our Site or ordering Products following a notice of such changes will indicate your acknowledgement of such changes and agreement to be bound by the terms and conditions of such changes.

Online Privacy Policy Only

This Privacy Policy applies only to information collected through our Site for product orders and not to information collected offline, at a Pop-up shop or through other services provided by Debola Designs.

Notice to California Residents

Subject to certain limits under California law (Section 1798.83 of the California Civil Code), California residents may ask us to provide them with (i) a list of certain categories of personal information that we have disclosed to third parties for their direct marketing purposes during the immediately preceding calendar year, and (ii) the identity of those third parties.
